Disclaimer and Limitations on Data

The Asbestos Litigation Database provides information concerning asbestos lawsuits filed between January 1, 1997 and December 31, 2003. En Banc's Asbestos Litigation Database does not contain information concerning every asbestos lawsuit filed during that period. En Banc is continuing to research, and may in its sole discretion add, asbestos lawsuits to the Asbestos Litigation Database for the January 1, 1997-December 31, 2003 period. The asbestos lawsuits that En Banc may add include lawsuits from jurisdictions listed in the "What's Coming" section of this website.

En Banc does not represent or warrant that it has collected all asbestos lawsuits filed during the January 1, 1997-December 31, 2003 period in any jurisdiction already represented in En Banc's Asbestos Litigation Database. En Banc may add to the Asbestos Litigation Database asbestos lawsuits filed during the period January 1, 1997-December 31, 2003 in those jurisdictions.

The information in En Banc's database is derived from court dockets or complaints filed in asbestos lawsuits. In some instances the dockets and complaints may not accurately reflect the parties in the case. This is for a variety of possible reasons. For example, if the complaint is amended to add or delete parties the database may record only what is in the complaint before the amendment. Similarly, dockets from which information is taken may not accurately reflect changes in the pleadings.

The Asbestos Litigation Database includes information concerning federal lawsuits that have been removed from state courts as well as information about the original state court cases. The Asbestos Litigation Database treats claims asserted in the removed federal case as separate and distinct from the claims asserted in the original state case. This may result in overcounting. Users of En Banc's Asbestos Litigation Database should take this into account.

Overcounting may also occur due to the re-filing of cases. In some instances plaintiffs dismiss their case without prejudice and later re-file it. The Asbestos Litigation Database may include both the original case and the re-filed case.

The Asbestos Litigation Database understates totals for cases Wayne County, Michigan because the Asbestos Litigation Database does not include the actual number of plaintiffs for that jurisdiction. The Asbestos Litigation Database presently assumes that there is one plaintiff per case.

For all counties in Virginia, Marion County, Indiana and Wayne County, Michigan, the Asbestos Litigation Database includes only certain commonly sued defendants; the database does not include data for all defendants in those jurisdictions.
